should just appoint a Dem to fill McConnells seat. It would force proof of life, and the state law that stripped him of that power should be challenged in court. Im sure Thune would refuse to seat the appointee, but I think its a fight worth having. BE BOLD!

(3,403 posts)We do need to understand the Republicans changed law in Ky to say that teh GOvernor could only appoint a person from a list of 3 prepared by the Republicans.
But Beshear should still move ahead with an addressive plan and put the Repblicans on the defenseive. THe first decision they would have to make is whether to oppose the nomination nased on the requirement for their input, or because McConnell is doing just fine.
forcing their hand on that would be a good step.

(346 posts)I wish the Governor would do this, saying the State of Kentucky needs an active Senator. It would force the Repubs to go into all kinds of legal conniptions - which would probably be successful - but it would EXPOSE the lying and manipulation. Lose the battle, win the war.

(56,486 posts)And is it worth it, like the KY Supreme Court will approve? Challenging the state law is a very good idea. Fight that out in the open, the opportunity to challenge it may not be revisited for generations. Any resulting clarity, positive or negative, would be welcome.

Then turned-around and expedited Trumps appointment to an open SC seat at another point

(107,042 posts)Are you saying that an appointment is not just better than an election, but the constitutional thing to do? That would be a bold move for a Democrat.

(56,486 posts)provided by Republicans. I don't think the State Constitution limits his appointment choices, but here comes that new law.

(340 posts)Kentuckys governor can no longer appoint a U.S. Senator. In April 2024, the General Assembly repealed the statute that had authorized temporary gubernatorial appointments, overriding Governor Beshears veto by wide margins in both chambers. Senate vacancies in Kentucky must now be filled entirely through a special election, with the seat remaining empty until voters choose a replacement.
House Bill 622, enacted as Acts Chapter 187, repealed KRS 63.200, the statute that had governed how a governor fills a Senate vacancy by appointment. Governor Beshear vetoed the bill on April 9, 2024. Three days later, the legislature overrode the veto with an 8117 vote in the House and a 295 vote in the Senate. The bill carried an emergency clause, making the repeal effective immediately upon the override on April 12, 2024.1
The repeal marked the end of a brief but unusual chapter in Kentucky politics. For roughly three years, the governor had possessed a constrained version of appointment power. With HB 622, the legislature decided that even a constrained version was too much and eliminated the authority altogether. Kentucky is now one of only four states where the governor cannot make any interim Senate appointment. North Dakota, Rhode Island, and Wisconsin follow the same approach, requiring the seat to stay vacant until an election fills it.

(43,307 posts)The voters in Kentucky would still have the final say, no matter who gets chosen for the interim.
At the moment there is nobody representing the people of Kentucky, and McConnell needs to speak up or resign.

(243 posts)Given Kentucky state law, the chances of a Democratic Senator approach nil so hope McConnell lives beyond first week of August and remains unable to vote, leaving us a non-voting Republican Senate seat until next Congress is seated in January. Seems best we can realistically hope for....
