The statement made by Trump was “she has made a living off her bad reporting, and will pay the price when our Multi Billion Dollar Lawsuit against The Failing New York Times gets to Court”.

There is not a court or jury that would treat that as a criminal threat.

But predictions, even ones that are childish, are not threats. We see predictions here on DU all the time. I would laugh at anyone claiming a prediction about the outcome of a court case was a "threat".

He filed his $15 billion defamation suit against the Times in the Middle District of Florida back in September. It was quickly dismissed with leave to refile because it was an ungodly mess that violated well settled federal pleading rules. He refiled a shorter complaint a month later and there has been procedural wrangling, particularly over whether the florida court is the proper venue for his suit. Meanwhile, back in March -- before the Situation Room article -- he mused about adding Haberman to that lawsuit. The fact that he hasn't yet done so doesn't mean much. The venue issue was just resolved in Trump's favor last week and there is a hearing on the Times motion to dismiss for failure to state a claim scheduled for July 22. He might amend before that hearing just to keep the case alive.
